This page is maintained by The I'm Too Much Club, LLC to answer common questions about our site and services. It is not a certification, legal opinion, or guarantee. If you need legal advice, please consult a qualified attorney.
Agreement to terms
These Terms of Service ("Terms") are a legal agreement between you and The I'm Too Much Club, LLC. By using our website, signing up for membership, joining a waitlist, or otherwise accessing our services, you agree to these Terms. If you do not agree, please do not use the site.
These Terms include important provisions that affect your legal rights, including a disclaimer of warranties, a limitation of liability, an indemnification obligation, a class-action waiver, and a governing-law and venue clause. Please read them carefully.
Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the site after changes means you accept the new Terms.
Who can use the site
The site is intended for users who are at least 13 years old (or the minimum age required in your jurisdiction, which may be as high as 16 in parts of the EEA and UK). If you are under 18, you may use the site only with the involvement and consent of a parent or guardian. By using the site, you represent that you meet these requirements.
You also represent that you are not barred from using the site under the laws of the United States or any other applicable jurisdiction, and that you will comply with all local laws when accessing the site.
Accounts and membership
Your obligations when creating and maintaining an account:
- Provide accurate, current, and complete information at signup and keep it up to date.
- Keep your login credentials confidential and do not share your account with anyone else.
- You are solely responsible for all activity that occurs under your account, whether or not authorized by you.
- Notify us promptly at hello@imtoomuchclub.com if you suspect unauthorized access or a security breach involving your account.
- One person, one account. Do not create accounts using automated means or on behalf of anyone other than yourself without permission.
User content and consent
When you submit your name, social handle, muchness statement, photos, or other content ("User Content"), you represent that you have the right to share it and that it does not violate anyone else's rights.
If you consent to being featured, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share your User Content in connection with club marketing, social media, and the site. You can revoke that consent at any time by emailing us at hello@imtoomuchclub.com; we will honor your request going forward, but content already published may not be fully retrievable.
Acceptable use
You agree to use the site only for lawful purposes and in a way that respects other members and the club. You may not, and may not allow anyone else to:
- Violate any applicable law, regulation, or third-party right.
- Harass, threaten, bully, stalk, abuse, or discriminate against any person or group.
- Post or transmit content that is illegal, defamatory, obscene, sexually explicit involving minors, hateful, violent, or that infringes intellectual property, privacy, or publicity rights.
- Upload viruses, malware, or any code intended to damage, disable, or gain unauthorized access to the site, our systems, or other users' devices or data.
- Use bots, scrapers, crawlers, or any automated means to access, collect data from, or interact with the site, except for well-behaved indexing by public search engines.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the site, except to the extent that applicable law prohibits this restriction.
- Interfere with or disrupt the site's security, performance, integrity, or availability, or bypass any technical measures we use to restrict access (including our bot-protection widget).
- Access or attempt to access another user's account or data, or misrepresent your identity, age, or affiliation with any person or organization.
- Use the site or any content from it to train machine-learning or AI models without our prior written consent.
- Resell, sublicense, or commercially exploit the site or its content, including certificates, badges, imagery, and copy, except as expressly permitted by these Terms.
We may investigate suspected violations, remove or disable content, and suspend or terminate access at our discretion, with or without notice.
Intellectual property
The I'm Too Much Club name, logo, certificate designs, badge designs, slogans, site content, and other materials are owned by The I'm Too Much Club, LLCor its licensors. You may not use them without our prior written permission, except for personal, non-commercial sharing of your own certificate or badge generated through the site.
Copyright complaints (DMCA)
If you believe content on the site infringes your copyright, send a written notice to hello@imtoomuchclub.com that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) the URL or specific location of the allegedly infringing material; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act on the owner's behalf. We may remove content and terminate repeat infringers in appropriate circumstances.
Third-party links and services
The site may link to or display content from third-party platforms such as Instagram, Facebook, YouTube, and others. We are not responsible for those platforms’ content, practices, or terms. Your interactions with third parties are governed by their own policies.
Disclaimer of warranties
The site and services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, The I'm Too Much Club, LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, that defects will be corrected, or that any content or communications will be accurate, reliable, or complete. You use the site at your own risk. Content posted by members reflects their own views and does not constitute advice from The I'm Too Much Club, LLC.
Limitation of liability
To the fullest extent permitted by law, in no event will The I'm Too Much Club, LLC or its officers, members, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the site, any content on it, or any conduct of other users, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been informed of the possibility of such damages.
Our total aggregate liability for all claims arising out of or related to the site or these Terms will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you paid us, if any, in the twelve (12) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Assumption of risk
The I'm Too Much Club encourages self-expression. You are solely responsible for what you share, how you present yourself, and any consequences that result. You acknowledge that public participation may attract attention, feedback, or criticism from others, and you assume that risk when you choose to be featured.
Indemnification
You agree to defend, indemnify, and hold harmless The I'm Too Much Club, LLC and its officers, members, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with: (a) your access to or use of the site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Any dispute arising from these Terms or the site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
You and The I'm Too Much Club, LLC each waive any right to a jury trial and agree that any dispute will be resolved on an individual basis only. You may not bring a claim as a plaintiff or class member in any purported class, consolidated, or representative action. Any claim must be filed within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.
Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, epidemics, internet or utility outages, or third-party service failures.
Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the site at any time. Sections that by their nature should survive termination will survive, including intellectual property, User Content license, disclaimers, limitation of liability, indemnification, governing law, and general provisions.
Your privacy rights
Our Privacy Policy explains what we collect, how we use it, and the rights you have. A few highlights are restated here for convenience; the Privacy Policy controls if there is any conflict.
California residents (CCPA/CPRA). You have the right to know, delete, correct, and port your personal information; to opt out of the sale or sharing of personal information; to limit the use of sensitive personal information; and to be free from discrimination for exercising these rights. We do not sell or share your personal information as those terms are defined under the CCPA/CPRA, and we honor the Global Privacy Control signal.
EEA / UK residents (GDPR). The I'm Too Much Club, LLC is the data controller for your personal information. You have the rights of access, rectification, erasure, restriction, portability, and objection, and you may lodge a complaint with your local supervisory authority. Personal data is transferred to the United States under appropriate safeguards, including the European Commission's Standard Contractual Clauses (and the UK Addendum where applicable).
Response times. We respond to verifiable rights requests within 45 days, with a possible 45-day extension where permitted by law. To verify a request, we may ask you to confirm information already associated with your account.
Automated decision-making. We do not use your personal information for automated decisions or profiling that produce legal or similarly significant effects about you.
Data retention
We keep your information for as long as your account is active or as needed to provide the service. When you ask us to delete your data, we remove it from our active systems within 30 days, and residual copies in encrypted backups are purged within 90 days of that request. We may retain limited records longer where required by law (for example, to resolve disputes or comply with tax and accounting obligations).
Security and breach notification
We use technical and organizational measures to protect your data, including encrypted connections and access controls. No online service is 100% secure, so we cannot guarantee absolute security. If we discover a security incident that affects your personal information, we will notify you and any applicable regulators without undue delay and, where required by law (such as GDPR/UK GDPR), within 72 hours of becoming aware of the breach.
General
If any part of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms without our prior written consent; we may assign them freely, including in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The I'm Too Much Club, LLC regarding the site and supersede any prior agreements on the same subject.
